These general sales conditions apply to all orders and purchases made via the webshop available at www.vps.be, operated by VPS International NV (hereinafter referred to as VPS), located at 1785 Merchtem, Korte Ridder Street 15, CBE-Nr. 0434,827,046.

These general conditions of sale always take precedence over any general or special conditions of the customer.

The protection of personal data is subject to a separate privacy statement. The use of the website is also subject to a disclaimer.

The consumer (private natural person) has the right to inform the company that he will not accept the purchase, without payment of a fine and without giving any motive within 14 calendar days from the day following the delivery of the goods or on the Conclusion of the Services Agreement.

If the customer decides to waive the purchase, the goods must be returned at their own expense and in the original packaging within the specified time limit.

The risk is transferred to the customer from the moment of delivery or collection of the goods. From that moment on, the customer bears the risk of loss, theft or complete destruction of the goods. The property is only transferred from the full payment of the price by the customer.

The delivery terms on the website are only indicative.

If an order cannot be delivered at the address specified by the customer, VPS reserves the right to terminate the agreement by law, without prejudice to its other rights under this agreement and the law. VPS will notify the customer in writing or by e-mail of the termination of the agreement.

The prices indicated on the website are inclusive of VAT, but excluding shipping costs. All other taxes or taxes arising between the time of ordering and the moment of delivery are also payable by the customer.

Payment must be made when ordering the goods or if otherwise agreed upon the delivery of the goods.

If the customer has not paid the invoice on the due date, an interest shall be payable by law and without prior notice, calculated in accordance with the statutory rate.

Amounts that have remained unpaid 8 working days after the dispatch of a notice of default are automatically and without prior notice increased by a flat-rate fee of 15, with a minimum of 75 EUR.

VPS is not liable for indirect damage (such as, but not limited to, loss of time, emotional damage, loss of income and loss of an opportunity).

All complaints must be reported by registered letter within seven working days from the delivery of the goods. If the complaint is found to be justified, the liability of VPS will be limited to repair or exchange of the delivered goods.

The contractual and additional contractual liability is always limited to the amount of the order.

Nothing in these general conditions of sale excludes the liability for deception, intent, gross negligence, death or bodily damage.

VPS is not responsible for cases of major force, i.e. situations that make the VPS very difficult (or high-cost) to carry out its obligations under this Agreement. These include: natural disasters, riots, war and military operations, national or local emergencies, acts or omissions of the Government, economic disputes of any kind, actions of workers, fire;, telecom breakdowns, ” Bugs “in third party software, flooding, lightning, explosions, collapses, as well as any act or omission of any person or entity that falls outside the reasonable control power of VPS.

This agreement is subject to Belgian law. Any dispute over the interpretation or application of this Agreement shall be subject to the jurisdiction of the Court of Brussels, unless the law requires a mandatory other court.
